COCA COLA BUSCA CRIMINALIZAR
A LAS VÍCTIMAS

El Fiscal Seccional 61 -Dr. Juan Carlos Losada Perdomo- profirió resolución de acusación en contra de los compañeros LUIS JAVIER CORREA SUAREZ, JORGE HUMBERTO LEAL, JUAN CARLOS GALVIS, LUIS EDUARDO GARCÍA, ÁLVARO GONZÁLEZ, JOSÉ DOMINGO FLÓREZ Y EDGAR ALBERTO PÁEZ MELO, todos miembros de la Dirección del Sindicato Nacional de Trabajadores de la Industria de Alimentos "SINALTRAINAL". La resolución de acusación fue proferida por la querella formulada por PANAMCO Colombia S. A. y la Embotelladota de Santander S. A. (embotelladoras de Coca Cola en Colombia) a raíz de la denuncia que el 20 de Julio de 2001 presentamos ante la Corte Federal del Distrito Sur de Florida, Estados Unidos, y que dimos a conocer en rueda de prensa el día anterior (19/07/2001). La denuncia fue instaurada ante la Corte Federal de Estados Unidos ya que en Colombia los casos se han mantenido en la total impunidad. El abogado de las embotelladoras, Dr. JAIME BERNAL CUELLAR, reclamó que se califique el mérito sumarial profiriendo en contra de los denunciados, resolución de acusación por los delitos de injuria y calumnia. El Dr. BERNAL CUELLAR -paradójicamente- era Procurador General de la Nación en la época en que se cometieron varios de los crímenes denunciados y ante quien oportunamente solicitamos su intervención, la cual nunca llegó. A cambio, la Fiscalía profirió preclusión de la instrucción a favor de los herederos de ISIDRO SEGUNDO GIL GIL, por desconocimiento de identidades. Isidro Segundo, quien fuera trabajador de Coca Cola en la planta de Carepa Antioquia, fue asesinado el 5 de diciembre de 1996, dentro de las instalaciones de la misma embotelladora. Recordamos que la señora ALCIRA DEL CARMEN HERRERA PÉREZ, esposa de Isidro, también fue asesinada el 18 de noviembre de 2000. La transnacional Coca cola insiste ante las autoridades colombianas para criminalizar varias de las víctimas de las violaciones a los derechos humanos de los cuales se benefició. La Fiscalía se presta para enjuiciar a quienes exponiendo nuestras vidas denunciamos graves crímenes, mientras que es responsable de la impunidad en que se encuentran centenares de crímenes contra trabajadores. Los trabajadores víctimas de esta persecución jurídica apelaremos la medida proferida por la Fiscalía.

COCA COLA SEEKS TO CRIMINALIZE ITS VICTIMS Fiscal (Attorney General) Branch 61 - Dr. Juan Carlos Losada Perdomo - sent a resolution of accusation against several members of the leadership of the national union of workers of the food industry SINALTRAINAL: LUIS JAVIER CORREA SUAREZ, JORGE HUMBERTO LEAL, JUAN CARLOS GALVIS, LUIS EDUARDO GARCIA, ÁLVARO GONZALEZ, JOSE DOMINGO FLOREZ, and EDGAR ALBERTO PAEZ. The resolution of accusation was sent as part of the legal process formulated by PANAMCO Colombia S.A. and Embotelladora de Santander S.A (bottlers of Coca Cola in Colombia) in response to the lawsuit we presented to the Southern Federal District Court in Florida, United States on July 20, 2001, and which was presented to the public in a press conference the day before (July 19, 2001). The lawsuit was filed in the Federal Court of the United States due to the fact that in Colombia our legal cases have remained in complete impunity. The lawyer representing the bottling plants, Dr. JAIME BERNAL CUELLAR, claimed that summary merit has been obtained with the sending of the resolution of accusation against the plaintiffs for the crimes of injury and libel. Paradoxically, Dr. BERNAL CUELLAR was Procurador General of the Nation in the time in which several of the crimes being denounced were committed and we had requested him to intervene in this situation, but he never responded. For a change, the Fiscalia sent the preclusion of the instruction in favor of the surviving relatives of ISIDRO SEGUNDO GIL GIL, for lack of knowledge of their identities. Isidro Segundo, worker at the Coca Cola plant in Carepa, Antioquia, was assassinated on December 5, 1996, inside the gates of the plant. We remember that ALCIRA DEL CARMEN HERRERA PEREZ, Isidro´s wife, was also assassinated on November 18, 2000. The transnational corporation Coca Coca is insisting to the Colombian authorities that several of the victims of the human rights violations which they themselves benefited from should be criminalized. The Fiscalia is prosecuting those of us who at the risk of our own lives are denouncing these grave crimes, while the real responsibility lies with the impunity in which hundreds of crimes against workers can be found. We the workers who are victims of this legal persecution are appealing the measure sent by the Fiscalia. |

IL La Procura Generale (Fiscalia) sezione 61 - nella personal del Dott. Juan Carlos Lozada perdomo - ha emesso una "risoluzione d'accusa" nei confronti di LUIS JAVIER CORREA, JORGE HUMBERTO LEAL, JUAN CARLOS GALVIS, LUIS EDOARDO GARCIA, ALVARO GONZALEZ, JOSE' DOMINGO FLOREZ E EDGAR PAEZ MELO, tutti menmbri della direzione nazionale del Sinaltrainal - Sindacato Nazionale dei lavoratori delle industrie alimentari. La risoluzione è stata emessa dopo la querela presentata dalle società PANAMCO Colombia SA e EMBOTELLADORA de Santander SA (imbottigliatrici della coca cola in colombia) in seguito alla nostra presentazione delle denuncie presso la corte federale di Miami - USA il 20 Luglio 2001 e che rendemmo pubbliche attraverso una conferenza stampa il giorno percedente. La denuncia venne presentata negli Stati Uniti a causa della totale impunità che ha avvolto i casi denunciati. L'avvocato delle società imbottigliatrici, Il sig. JAIME BERNAL CUELLAR, ha richiesto l'apertura del procedimento per calunnie e ingiurie. Paradossalmente l'avvocato fu PROCURATORE GENERALE DELLA NAZIONE proprio nell'epoca in cui vennero commessi i delitti denunciati e che nonostante le nostre richieste non intervenne mai. Inoltre la Procura profila la preclusione dell'istruttoria nei confronti dei massacratori di ISIDRO SEGUNDO GIL GIL perché sconosciuti. ISIDRO SECUNDO fu lavoratore della coca cola nella fabbrica di Carepa Antioquia e venne assassinato il 5 dicembre 1996 dentro la fabbrica stessa. Ricordiamo anche che sua moglie ALCIRA DEL CARMEN HERRERA PEREZ venne assassinata il 18 Nov. 2000. La transnazionale coca cola cerca di fronte alle autorità colombiane di criminalizzare le vittime delle violazioni dei diritti umani dai quali ha tratto benefici. La Procura si presta al gioco perseguitando le vittime e lasciando nella totale impunità gli autori dei delitti contro i lavoratori. I lavoratori vittime di questa persecuzione impugneranno legalmente il procedimento aperto dalla Procura. Bogotà 6 agosto 2003

OFENSIVA JURÍDICA CONTRA VICTIMAS DE COCA COLA

Un nuevo proceso jurídico radicado bajo el número 675549-280 avanza en la Fiscalia 55, contra victimas de Coca Cola en Colombia, por las denuncias que se realizaron el 5 de diciembre de 2002. El pasado 6 de agosto de 2003, la Fiscalia cito a LUIS JAVIER CORREA SUÁREZ, Presidente de SINALTRAINAL para que rindiera declaración sobre los actos realizados el 5 de diciembre de 2002, frente a las instalaciones de Coca Cola, en momentos en que se hizo entrega oficial de la citación al representante legal de la transnacional, para que se hiciera presente en la Audiencia Pública Popular "Héctor Daniel Useche Beron" a responder por las violaciones que contra los derechos humanos de sus trabajadores ha ejecutado en los últimos años y por el beneficio obtenido con el asesinato de varios de nuestros afiliados. Coca Cola FEMSA, a través de su apoderada Doctora Jacqueline Barros instauró denuncio penal contra desconocidos por el delito de injuria. Coca Cola pretende criminalizar nuevos trabajadores por el hecho de haberla denunciado nacional e internacionalmente en las Cortes de los Estados Unidos. En ocasión anterior se denunció a la Fiscalia 61, por proferir resolución acusatoria contra LUIS JAVIER CORREA SUÁREZ y otros miembros de Sinaltrainal, para que respondan por los delitos de injuria y calumnia contra la misma transnacional. Coca Cola pretende penalizar nuevas víctimas de su represión. Esto hace parte de la ofensiva general de la transnacional para acallar la protesta y denuncia de sus trabajadores. AGAINST THE VICTIMS OF COCA COLA CONTINUES

| A new legal case, filed under number 675549-280 is advancing in the
Fiscalia (Prosecutors) office, against the victims of Coca Cola in Colombia,
for the denouncements they made on December 5, 2002.
This past August 6, 2003, the Prosecutors office called LUIS JAVIER CORREA SUAREZ, President of SINALTRAINAL, to make a statement about the events that took place on December 5, 2002, in front of the gates of Coca Cola, when the legal representative of the transnational corporation was officially sent an invitation to present himself at the Popular Tribunal "Hector Daniel Useche Beron" to respond to the human rights violations that the company has committed in recent years against its own workers and to comment on the benefit it obtained due to the assassination with several of our members. Coca Cola FEMSA, through its legal representative Dra. Jacqueline Barros, filed a penal lawsuit against unknown persons for the crime of harm committed to the company. Coca Cola is trying to criminalize a new set of workers for the act of having denounced it both nationally and internationally in the courts of the United States. In a previous occasion, we have denounced the Prosecutors office #61 for sending an accusation against LUIS JAVIER CORREA SUAREZ and other members of SINALTRAINAL for the crimes of harm and libel against this same transnational corporation. Coca Cola is trying to penalize a new set of victims of its repression. This is part of the general offensive the transnational corporation is launching to silence the protests and denouncements of its workers.
